GUIDANCE NOTES - PLEASE READ

 

Your valued custom is important to us and we want to satisfy your purchasing requirements. These Terms and Conditions of Sale ("the Terms") are important to you and to AR Software and should be considered carefully before you place an order with us.

These Terms have been designed to protect your rights as a valued customer, to protect our rights as a business and to create an understanding between us.

The Terms apply to all transactions carried out on our website and Auction sales.

For purposes of the Terms "we", "us", "our" refer to AR Software and "you" and "your" refer to you the Customer unless the context clearly indicates otherwise.

 

PURCHASING FROM US

 

On your order (Purchase) a contract comes into effect between us.

If payment has not been received within 7 days, Your item will be put back up for sale and when your payment is received, We will for fill your order as soon as possible, we shall not be liable for any consequential loss due to being out stock and a delay occurring, In the event we are unable to provide the original item, then your money will be refunded less any Auction charges incurred (if relevant)

Ownership for the goods transfers when we have been paid in full and the item has been sent.

All products are supplied subject to availability. In the event that we are unable to supply any product, we will inform you of this as soon as possible and we shall not be liable for any consequential loss.

Occasionally a manufacturer or supplier may change the specifications, packaging or RRP of a product and at times will not seal (shrink wrap) the product with notice to us. Should this happen to a product you have ordered (Purchased) from us we will send the product at the purchased price and we will notify you of any change in specifications if the changes are significant. All goods sent will still be brand New (unless stated different by us) and we shall not be liable for any consequential loss, you can however return the item back to us. (See RETURNS & REFUNDS)

Once the goods have been delivered to you, you will hold them at your own risk and will be liable for their loss or destruction. We will not be liable for the loss or destruction of the goods once they have been delivered to you.

 

DELIVERY (shipping)

 

Goods are only processed for delivery when payment has been received (cleared) in full.

 

UK items are automatically sent using “2nd class” postage (unless stated otherwise by yourself and agreed by us and any additional charges paid in full)

Additional Options (To be stated by customer and agreed by us)

1st“& “2nd  class Recorded” includes insurance against damage or loss during shipping; this does not cover consequential loss, Additional charges to be paid in full by you.

1st  Class Basic”, Additional charges to be paid in full by you.

Special Delivery” offers next working day delivery before 12pm and includes insurance against damage or loss during shipping; this does not cover consequential loss, Additional charges to be paid in full by you.

Where we state delivery times, days or dates, these are estimated and we shall not be liable for delays or consequential loss resulting in these times not being met.

We shall not be liable for delays, loss, damage or consequential loss once the goods have been past onto the relevant company(s) for shipping.

Insurance All items have basic insurance, this covers items for damage in transit or total loss, no item will be considered lost until 10 business days have passed, after such time we will commence the process of a claim into the lost item, this process can take up to 3 weeks to complete. In total a damaged item can take up to 3 weeks and a lost item can take up to 5 weeks to process.

In the event of a loss or damage, we will contact the relevant postal company; NO replacements or refunds will be sent or issued until the matter is resolved in full between the relevant postal company and us.

Insurance (OPTIONAL) is available which will fully cover your item against Damage or Loss during transit, Cost shown or are available on request. A damaged item will be replaced or refunded once the item has been returned back to us. A lost item will be replaced or refunded after 10 business days has passed.

 

 

International Items are automatically sent using basic “Airmail” postage (unless stated otherwise by yourself and agreed by us and any additional charges paid full); this service offers NO insurance against loss, consequential loss or damage during shipping.

Additional Options (To be stated by customer and agreed by us)

Surface Mail” offers NO insurance against loss, consequential loss or damage during shipping.

Airmail + Signature” & “Surface mail + Signature” includes insurance against damage or loss during shipping; this does not cover consequential loss.

P&P

 

Postage and Packing charges shown in auction listings include: Postage, Packing and Handling.

Insurance (OPTIONAL) is available which will fully cover your item against Damage or Loss during transit (see DELIVERY)

Additional services can be requested and any additional charges are to be paid in full by you.

 

“Postage discount” applies only when purchases are combined and only 1 payment is made for those purchases.

 

PAYMENT

 

Payments received for orders before 11.59pm, Will be posted next working day.

Any overpayments due to your error will not be refunded.

Cash is sent at your own risk, we shall not be liable for loss and for any consequential loss arising from this.

Charges incurred in sending payment are your responsibility. (i.e. Postage charges to send Cheques, Postal Orders or Cash; Bank Charges for Writing Cheques, Transfers or Money Orders; Charges for crediting online e-payment accounts)

 

UK

Cheques will be given 3 full business days clearance and your order will be Posted on the 4th business day. Cheque Guarantee numbers will be ignored due to the numbers not being physically checked by us.

Postal Orders, Orders will be posted in the next mail collection.

Cash, Orders will be posted in the next mail collection

Bank Transfers, once received orders will be posted in the next mail collection.

Nochex, Orders will be posted in the next mail collection.

Paypal, Your original or First payment incurs NO charge, Any additional payments sent due to an underpayment will incur a charge, We shall not be liable for any consequential loss caused due delays arising from underpayment.

 

International

International Postal Orders must be in UK Pounds and will be given 4 full business days clearance and your order will be Posted on the 5th day

International Money Orders must be in UK Pounds and will be given 4 full business days clearance and your order will be Posted on the 5th day

Cash is accepted in your own currency, Advertised currency conversions will be ignored and our own Banks rate will be used.

Bank Transfers, once received orders will be posted in the next mail collection.

Paypal, original or First payment incurs NO charge, Any additional payments sent due to an underpayment will incur a charge, We shall not be liable for any consequential loss caused due delays arising from underpayment.

 

RETURNS & REFUNDS

Non Faulty

If you decide you do not require the goods, you may return the goods to us within seven days from the date on which you received them provided they are returned in their original packaging and with the seal unbroken. The return postage (shipping) will be at your own cost and we recommend you select an appropriate service to insure safe delivery to us. We shall not be liable for loss or damage in the process of the goods being returned and in this event will not refund the purchase price.

We shall refund the purchase price of the goods less: -

Charges incurred by us (which were shown at time of purchase)

Items ordered into stock specifically for your order.(which were shown at time of purchase)

Postage and packing (Shipping & Handling) costs

Auction charges incurred (if relevant)

Online Payment charges incurred (if relevant)

We will refund your money Within 30 days of the order being cancelled.

We shall not be liable for any consequential loss due to the above.

Changed Specifications

If the goods sent to you have had the specifications changed significantly, we will offer an exchange or refund the purchase price of the item on receipt of the original goods. (This does NOT apply to changed packaging)

We shall not be liable for any consequential loss due to the above.

Faulty Goods

If goods are faulty, you must return them back to us for checking, if found to be faulty a replacement will sent to you.

If goods are found NOT to be faulty and the cause is a compatibility issue due to incorrect specifications of the goods, we shall refund the purchase price of the goods or offer an exchange providing we were informed of your machines specifications previous to the order being sent.

In the event we were not informed of your machines specifications, we will still offer an exchange, but you will be liable for any additional postage charges incurred and must be paid in full before the exchange is sent, or we will refund the purchase price of the goods less: -

Charges incurred by us (which were shown at time of purchase)

Charges incurred from a supplier specific to ordering your goods into stock (which were shown at time of purchase)

Postage and packing (Shipping & Handling) costs

Auction charges incurred (if relevant)

We will refund your money Within 30 days of the order being cancelled.

We shall not be liable for any consequential loss due to the above.

Incorrect goods sent

If the goods sent to you are incorrect due to our own fault, the incorrect goods must be returned in the original packaging and with the seal unbroken, and on receipt the correct goods will be despatched at NO extra cost to you.

In the event you order the wrong goods, you will be liable for any additional postage costs incurred by yourself and us in correcting the error. We recommend you select an appropriate service to insure safe delivery to us. We shall not be liable for loss or damage in the process of the goods being returned and in this event will not refund the purchase price or any further goods.

We shall not be liable for any consequential loss due to the above.

 

 

LIABILITY and DISCLAIMER


Information Supplied by us when you purchase the goods will have been compiled from information given to us and we will try to be as accurate, clear and descriptive as possible, we shall not be liable for inadequate information causing loss, consequential loss or damage.

To fullest extent permitted at law and except in respect of death and personal injury caused by negligence on our part or on the part of our employees we shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty condition or other term or any duty at common law or under express terms of the contract for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by negligence on our part or the part of our employees or agents or otherwise) which arise from or in connection with the use of the website or auction listings, the supply of goods or their use or resale by you, and our entire liability under or in connection with the contract shall not exceed the price of the goods, except expressly provided in these conditions. This does not affect your statutory rights.

 

 

LFORCE MAJEURE


We reserve the right to delay delivery or to cancel the order or reduce the volume of the goods ordered by you (without any liability to you) if we are prevented from or delayed in the carrying on of our business due to circumstances beyond our reasonable control including without limitation acts of God, illness, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock out, strikes or other labour disputes (whether or not relating to either party's work force), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials Provided that if the event in question continues for a continuous period in excess of 14 days, you shall be entitled to give us notice in writing to terminate the order.

 

 

INVALIDITY
